General terms and conditions of the company Amato-Heggendorn Trading (www.italiangourmetshop.ch)

1. conclusion of contract and delivery

1.1 We conclude contracts via www.italiangourmetshop.ch exclusively in German. The basis of a contract between Amato-Heggendorn Trading and the customer are always the GTC valid at the time of the conclusion of the contract. Verbal collateral agreements do not exist; deviating regulations are only valid if they have been agreed upon in writing between Amato-Heggendorn Trading and the customer. Errors and price changes of the products are reserved.

1.2 By clicking the button “Submit Order” you place a binding order for the products in the shopping cart. We will confirm the receipt of your order immediately by e-mail after sending the order. A binding contract is concluded upon receipt of the order confirmation. Please note that in case of prepayment (reservation) the delivery of the ordered goods will take place as soon as we have received the payment of the full purchase price as well as shipping costs and possible postage fees. Therefore, we ask you to make the transfer of the purchase price immediately after receipt of the order confirmation, but no later than within 7 days. After this period we take the liberty to release the reserved items.

1.3 In exceptional cases it may happen that a delivery of the ordered goods cannot be made if we have duly ordered the goods on our part but have not been supplied correctly or in time. The prerequisite is that we are not responsible for the lack of availability of the goods and that we have informed you of this circumstance without delay. In the event that the goods are subsequently unavailable, we will of course immediately refund any payments already made.

1.4 We do not assume the risk of having to procure ordered goods (procurement risk). This also applies to orders for goods that are only described in terms of their type and characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods ordered by us from our suppliers. We deliver orders to you within Switzerland. If delivery times are specified as working days, we understand this to mean all days from Monday to and including Friday, with the exception of public holidays.

5) Login to the Internet store after registration and entering the login details (e-mail address and password).
6) Re-checking or correction of the respective data entered.
7) Binding sending of the order by clicking the button “Send order”.

Before the binding submission of the order, the consumer can, after checking his details, return to the Internet page on which the customer’s details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the “Back” button contained in the Internet browser used by him. We confirm the receipt of the order immediately by an automatically generated e-mail (“Order Confirmation”). With this we accept your offer. Storage of the contract text for orders via our internet store: We will send you the order data and our GTC by e-mail. You can also view the GTC at any time at www.italiangourmetshop.ch/allgemeine-geschaeftsbedingungen.

3. prices, shipping costs, payment, due date

3.1 The prices listed in the offer at the time of the order shall apply. The prices stated are final prices, i.e. they include the applicable statutory value-added tax.

3.2 Shipping costs depend on the size and weight of the ordered items.

3.3 For the shipment of particularly large, heavy or valuable items, different shipping charges may apply, which we will indicate during the sale for each product individually on the product detail page and on the order page.

3.4 The consumer has the option of payment in advance, via Paypal or in cash (CHF only) at pickup.

3.5 If the consumer has chosen payment in advance, he undertakes to pay the purchase price immediately after conclusion of the contract (no later than 7 working days after placing the order). After this period we take the liberty to release the reserved goods.

3.6 Purchase on account is currently not possible.

4. right of revocation/right of return

Return of perishable food items such as olive oil or sausages is excluded, as it cannot be guaranteed that the items have been stored according to the strict standards of the Food Inspectorate.

5. legal liability for defects

5.1 The statutory warranty for defects shall apply. Amato-Heggendorn Trading expressly reserves the right to supply the Buyer with a replacement free of defects in the event of asserted and established defects in the purchased item.

5.2 Exchanges and complaints can only be considered within 7 days after receipt of the order. The revocation must be made in writing and by returning the delivered goods. Always include a copy of the order documents with a return. NO right of exchange exists for perishable goods (all foodstuffs).

5.4 Amato-Heggendorn Trading shall be liable exclusively for damage caused by gross negligence or intentionally. Any liability of Amato-Heggendorn Trading for indirect or consequential damages, loss of profit, loss of earnings is excluded.

5.5 Should individual provisions of the contract, including these provisions, be or become invalid in whole or in part, or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. In place of the invalid or missing provisions, the respective statutory provisions shall take effect.

6. retention of title

We retain ownership of the goods until full payment of the purchase price.

7. place of jurisdiction

The place of jurisdiction of both contracting parties is Reinach BL.
